Welcome to Siddharth Yonzone Films. These Terms & Conditions outline the rules and regulations for the services provided by Siddharth Yonzone Films. By engaging our services, you agree to adhere to the following terms:

    1. Copyright and Ownership

   - Ownership Rights: Siddharth Yonzone Films retains the full copyright and ownership of all content produced. This includes, but is not limited to, photographs, videos, edited content, and any other media generated during the course of our services.

   - Usage of Content: We reserve the right to use the content produced for our internal training purposes, advertising campaigns, promotional materials, and for showcasing in our portfolio. This helps us in improving our services and promoting our business.

   - Client Usage: Clients are granted a non-exclusive license to use the delivered content for personal or commercial purposes as agreed upon, but they must credit Siddharth Yonzone Films appropriately.

2. Liability

   - Safety and Mishaps: Siddharth Yonzone Films is not liable for any injuries, accidents, or mishaps that occur during the production process. This includes, but is not limited to, injuries to individuals, damage to property, or any other incident that may occur on set.

   - Natural Calamities: We are not responsible for delays, interruptions, or cancellations caused by natural calamities such as earthquakes, floods, storms, or other acts of God that may affect the scheduled production.

   - Lost or Damaged Content: While we take utmost care in handling and storing footage and pictures, we are not liable for any loss or damage to the content once the project has been delivered to the client.

 

    3. Booking and Payments

   - Advance Booking: To ensure the highest quality of service, advance booking is mandatory for all projects. Last-minute bookings are not accepted.

   - Non-Refundable Deposit: A non-refundable deposit of 35% of the total project cost is required to secure your booking. This deposit ensures your reservation in our schedule.

   - Payment Schedule: On the day of the event, 70% of the total project cost must be paid. The remaining balance is due upon the completion and delivery of the project. Payment plans may be discussed and agreed upon in the initial meeting.

   - Accepted Payment Methods: We accept payments via bank transfer, credit card, and other mutually agreed-upon methods. Details for payment will be provided upon booking.

 

    4. Event Postponement

   - Rescheduling: In the event that an event needs to be postponed, clients must notify us as soon as possible. We will make every effort to accommodate the new schedule, but this may depend on our availability.

   - Additional Costs: Rescheduling may incur additional costs, especially if it affects our ability to schedule other clients or if the postponement results in additional work.

 

    5. Post-Production Duration

   - Timeframe: The minimum duration for post-production is three months. This is due to the detailed and high-quality work involved in editing and producing the final content.

   - Extended Duration: The timeframe may extend depending on the volume of ongoing projects and the complexity of the current project. Clients will be kept informed of the progress and any potential delays.

 

    6. Client Meetings

   - Pre-Booking Meeting: A pre-booking meeting with the client is mandatory. This meeting helps us understand the client's needs and expectations, ensuring that the final product meets their requirements.

   - Consultation: During this consultation, we will discuss the project details, timelines, creative direction, and any specific requests from the client. This is an opportunity for clients to ask questions and clarify any doubts.

 

    7. Scope of Work

   - Defined Work: Only the work specified in the contract will be performed. Any additional work or changes to the original plan must be agreed upon in writing and may incur extra charges.

   - Change Requests: Clients may request changes or additional work, but these must be discussed and approved by Siddharth Yonzone Films. Additional fees will be calculated based on the nature and extent of the requested changes.

 

    8. Client Responsibilities

   - Information Provision: Clients must provide all necessary details and information required for the production. This includes but is not limited to schedules, location details, contact information, and any specific requirements or preferences.

   - Cooperation: Full cooperation from the clients is expected to facilitate a smooth and successful production process. This includes timely communication, adherence to schedules, and responsiveness to our requests for information or feedback.

   - Logistics and Permissions: Clients are responsible for securing any necessary permissions, permits, and access to locations where the production will take place.

    9. Cancellation Policy

   - Client-Initiated Cancellations: If a client decides to cancel a project after booking, they must notify Siddharth Yonzone Films as soon as possible. The 35% deposit is non-refundable. If the cancellation occurs within [a specified period, e.g., 10 days] before the event, additional cancellation fees may apply.

   - Company-Initiated Cancellations: In the rare event that Siddharth Yonzone Films must cancel a project due to unforeseen circumstances, we will refund any payments made by the client and assist in finding a suitable alternative.

 

    10. Intellectual Property

   - Licensing and Usage: Clients may use the final content for personal or commercial purposes as specified in the contract. Any additional usage, including modifications, redistribution, or resale, must be approved by Siddharth Yonzone Films.

   - Raw Footage: Raw footage and unedited photos remain the property of Siddharth Yonzone Films and will not be provided to the client unless specifically agreed upon in writing, which may involve additional costs.

 

    11. Confidentiality

   - Client Privacy: Siddharth Yonzone Films respects client privacy and confidentiality. Any personal information or sensitive details provided by the client will be handled with discretion and will not be disclosed to third parties without the client’s consent.

   - Company Privacy: Likewise, clients agree not to disclose any proprietary information, techniques, or pricing details related to Siddharth Yonzone Films.

 

    12. Force Majeure

   - Siddharth Yonzone Films shall not be liable for any failure to perform its obligations under this agreement if such failure is due to circumstances beyond its reasonable control, including but not limited to acts of God, war, riot, civil commotion, or governmental actions.

 

    13. Dispute Resolution

   - Governing Law: These terms and conditions are governed by and construed in accordance with the laws of Darjeeling jurisdiction.

   - Mediation and Arbitration: In the event of a dispute arising out of or relating to these terms and conditions, the parties agree to first attempt to resolve the dispute through mediation. If mediation fails, the dispute will be resolved through binding arbitration.

 

    14. Final Delivery

   - Formats: Final deliverables will be provided in the formats agreed upon during the initial consultation. Any requests for additional formats or copies may incur additional fees.

   - Approval Process: Clients will be given the opportunity to review the final content. Any minor changes or corrections will be accommodated within reason, but major revisions may incur additional charges.

 

    15. Retention of Copies

   - Siddharth Yonzone Films will retain copies of all final edited content for a period of [specify time, e.g., one year] for archival purposes. Clients are encouraged to make their own backups of the delivered content.

 

     16. Client Obligations During Production

   - Access and Cooperation: Clients must ensure that Siddharth Yonzone Films has access to the necessary locations and subjects during the production. This includes securing permissions for shooting in specific locations and ensuring that all participants are available as required.

   - Environmental Conditions: Clients are responsible for providing a safe and suitable environment for filming, including appropriate lighting and sound conditions if necessary.

 

    17. Third-Party Services

   - Subcontracting: Siddharth Yonzone Films reserves the right to subcontract any part of the project to third parties. We will ensure that any subcontractors used will meet our high standards of quality and professionalism.

   - Third-Party Content: If third-party content (e.g., music, stock footage) is required, the client must obtain the necessary licenses or permissions. Siddharth Yonzone Films can assist in this process, but any additional costs will be the client’s responsibility.

 

    18. Insurance

   - Insurance Coverage: Clients are encouraged to have appropriate insurance coverage for the event or production. Siddharth Yonzone Films carries its own liability insurance, but this may not cover all potential incidents.

   - Equipment Insurance: Clients are responsible for any damage to Siddharth Yonzone Films' equipment caused by the client or their guests during the production.

 

    19. Archival and Storage

   - Data Storage: Siddharth Yonzone Films will retain copies of all final edited content for a period of one year. After this period, we reserve the right to delete the content unless otherwise agreed upon.

   - Raw Footage Storage: Raw footage will be stored for a period of six months post-completion of the project. If clients require storage beyond this period, additional fees may apply.

 

    20. Amendments to Terms and Conditions

   - Changes to Terms: Siddharth Yonzone Films reserves the right to amend these Terms & Conditions at any time. Any changes will be communicated to clients in writing and will apply to all future projects.

 

    21. Non-Disclosure Agreement (NDA)

   - Confidential Projects: For projects that involve confidential information or proprietary content, both parties may enter into a Non-Disclosure Agreement to ensure that all sensitive information is protected.

 

    22. Feedback and Testimonials

   - Client Feedback: We value client feedback and may request testimonials upon project completion. Clients agree that any feedback provided may be used for promotional purposes.

   - Review Process: Clients will be given an opportunity to review and approve testimonials before they are published.

 

    23. Health and Safety

   - Compliance: Siddharth Yonzone Films complies with all health and safety regulations. Clients must ensure that any location used for production meets these standards and does not pose any health or safety risks to our team.

 

  24. Final Delivery and Acceptance

   - Delivery Confirmation: Final deliverables will be provided electronically or via physical media as agreed upon. Clients must confirm receipt and acceptance of the final product within seven days.

   - Correction Requests: Any requests for corrections or adjustments must be made within seven days of receipt. Additional changes beyond this period may incur extra fees.
